Terms & Conditions


These Terms & Conditions govern the provision of broadband internet access (“Service”) by Newmarket Broadband (“Provider”). By accessing or using the Service, you (“Customer”) agree to these Terms.

1. Service Description

Newmarket Broadband provides shared broadband internet connectivity on a best-efforts basis. The Service does not include any Service Level Agreement (SLA) and no guarantee is given regarding uptime, speed, latency, bandwidth, or performance.

2. Service Availability

Service availability may be affected by maintenance, upgrades, equipment failures, upstream provider issues, power outages, or other circumstances beyond the Provider’s control. Newmarket Broadband will make reasonable efforts to restore service where interruptions occur but does not guarantee restoration times.

3. Acceptable Use

Customers must use the Service lawfully and responsibly. The Service must not be used to:

  • Conduct illegal activities

  • Send spam or malicious traffic

  • Distribute malware or attempt to compromise networks or systems

  • Interfere with the use of the Service by others

Newmarket Broadband reserves the right to restrict, suspend, or terminate access where misuse or unlawful activity is suspected.

4. Equipment

Any equipment supplied by Newmarket Broadband remains the property of the Provider unless otherwise agreed in writing. Customers must not tamper with, relocate, or modify Provider equipment.

5. Fees and Payment

Where fees apply, Customers agree to pay all charges as invoiced by Newmarket Broadband. Payment terms will be specified on the invoice or service agreement. The Provider may suspend the Service if payments become overdue.

6. Customer Responsibilities

Customers are responsible for maintaining the security of their own devices and internal networks, including installing appropriate security updates, firewalls, and antivirus protection. Customers are responsible for the activity of users connected through their network.

7. Liability

The Service is provided “as is” without warranties of uninterrupted or error-free operation.

To the fullest extent permitted by law, Newmarket Broadband will not be liable for any loss of business, loss of profits, loss of data, or any indirect or consequential damages arising from the use of, or inability to use, the Service.

Where liability cannot be excluded, Newmarket Broadband’s total liability shall not exceed the amount paid by the Customer for the Service in the three (3) months preceding the claim.

Nothing in these Terms limits liability where such limitation is not permitted under UK law.

8. Suspension or Termination

Newmarket Broadband may suspend or terminate access to the Service if these Terms are breached, if unlawful activity is detected, or if payment obligations are not met.

9. Changes to the Service or Terms

Newmarket Broadband may update or modify these Terms or the Service from time to time. The latest version will always be published on the Newmarket Broadband website.

10. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the jurisdiction of the courts of England and Wales.
